Airline Sued After Passenger Complains of 'Squashed' Seating Arrangement

Italian lawyer, Giorgio Destro, is suing Emirates airline for what he is deeming "uncomfortable" seating conditions during his 9 hour flight.

Destro says he was seated next to an overweight man and it made his flight unbearable.

"For nine hours, I had to stand in the aisle, sit on seats reserved for the cabin crew when they were free, and in the final phase of flight resign myself to suffer the 'spillover' of the passenger at my side," Destro told an Italian newspaper.

The unhappy passenger says he asked to move seats on multiple occasions but was told the flight was fully booked. Destro took his complaint to the airline who offered no compensation for his self-described unacceptable flight.

After receiving nothing from Emirates airline, Destro is now suing them for a total of $3100USD, $852 for the price of the ticket and $2250 in 'damages.' The hearing is set for October 20th, 2016.

It's a topic that is rather sensitive these days, overweight fliers. Most airlines require overweight passengers to purchase a second additional seat so they don't encroach on the space of the person next to them. American Airlines is one of the few airlines that will give this seat for free, if it is available.
