Widower Who Lost Wife, Unborn Baby To Drunk Driving Speaks After Driver Is Sentenced

One year ago, a pregnant mother of three was killed in a drunk driving accident. 29-year-old Krystil Kincaid of San Jacinto was struck and killed in a head-on collision.

"Krystil leaves behind a husband and three children, including an 11-year-old daughter and two sons, ages 8 and 4," the GoFundMe page for Krystil reads. "Krystil was 8-months pregnant, her unborn child and her have both passed away after a suspected DUI-related head-on collision in Hemet. When officers arrived they found the Chrysler was “partially on fire,” but officers were able to quickly extinguish the flames. Despite extinguishing the fire, officials could not immediately pull the victim from her vehicle, due to the extensive amount of damage her mini-van sustained, which had pinned both the victim’s legs under the dash of her Chrysler. Firefighters used the 'Jaws of Life' to extricate the trapped woman from her vehicle and she was air-lifted to an area trauma center, where both she and her unborn child later died."

The driver, Cuban boxer Marcos Forestal, live-streamed himself after the accident and claimed that it was Krystil who had hit him.

"Look what happened to me, guys," he said in Spanish in the video. “A car crossed in front of me and look what happened to my car."

Police disagreed with this.

“Forestal displayed symptoms of alcohol intoxication and was arrested,” the Helmet Police Department stated at the time.

Zach Kincaid, Krystil's husband, was left to grieve and learn how to be a single parent, all while struggling with the anger he felt towards the driver. Zach wrote about his disbelief that Forestal would only be facing 10 years maximum in prison, even though he killed two people. He also shared gut-wrenching pictures from the funerals of his wife and daughter.

A drunk driver speeding down a two lane highway at 85+mph in the wrong lane around a blind corner destroyed my family. The max sentence for killing my wife and daughter is 10 years max. The state of California doesn't think there was intent, but I know driving recklessly in that manner, he didn't intend anything good....

My daughter's due date was October 9th, a 36 week old fully developed baby isn't considered a person in the state of California. How do I explain to my children this injustice. My children and I have never felt so disposable... Look at the devastation left behind that is my family and tell me it isn't time for change....imagine if this was your family... Who will fight with me for change? Who will spread this like wild fire? Who will write their representatives and demand change?? We cannot as a society look the other way any longer. Driving drunk is intent..

Forestal ended up pleading guilty to gross vehicular manslaughter and was sentenced to 10 years in prison. Zach once again took to Facebook to voice his displeasure, and also defend his decision to bring his kids to the sentencing.

Yesterday during the sentencing the judge read Marco Forestal's statements to the probation interview. Marco claimed my wife hit him, he claimed he couldn't help my wife because he didn't see her vehicle, or call 911 for help because his battery was at 3%. He also claimed he only had 2 drinks of bailey's 15 minutes before the crash. The fact that you can still see the chunks of asphalt missing from the road from the impact on the north bound lane of where my wife was driving baffles my mind at the inability for this man to take responsibility for murdering my family.

The fact he chose to Facebook live himself where he can see the video on selfie mode and you can clearly see my wife's car on fire in the background makes his statements of not seeing her car and his low battery claim even more of an insult to my family and our society. The fact he was intoxicated over double the legal limit at the time of the crash also burned inside of my body. This scum bag will sit around feeling sorry for himself, and never will take responsibility.

The fact he will only spend 5 years behind bars and he took my wife's and daughters lives, and ruined mine and my surviving children's lives is beyond frustrating and soul breaking. This will continue to happen to people if the lawmakers in California keep pandering to alcohol companies and DUI defense lawyer lobbyists. It's disgusting the lawmakers care more about their kick backs and perks than the lives and safety of the people in our community. Demand change before your family is next...

I've also received some backlash from bringing my children to the hearing yesterday. I felt it was important to show my children that monsters don't have fangs or are some mystical creatures, monsters are people and they got to see a real one yesterday. Both of my girls stood up yesterday and spoke for their mother against this monster. My children will always be encouraged to stand up against fear.
